INLAND WETLANDS AND WATERCOURSES COMMISSION
REGULAR MEETING
February 5, 2015

Present were:  Skip DiCamillo, Dave McCulloch, Janet Bechtel, Mike Moran, Tim Rollins and Evan Griswold.

MINUTES OF REGULAR MEETING DATED NOVEMBER 18, 2014

Janet Bechtel made a motion to approve the Regular Meeting Minutes dated November 18, 2014.  Mike Moran seconded the motion.  The motion passed unanimously.

MINUTES OF SITE WALK MEETING DATED NOVEMBER 29, 2014

Janet Bechtel made a motion to approve the Site Walk Meeting Minutes dated November 29, 2014.  Tim Rollins seconded the motion.  The motion passed unanimously.

NEW BUSINESS

WETLANDS PERMIT 12-06 – APPLICATION OF ENOK PEDERSEN & DUBOIS FORESTRY MANAGEMENT – FOLLOW UP REPORT

Mr. Pedersen was present to update the commission on the progress of his silvicultural project.  He stated that all of the cutting had been done and that the expected amounts were removed.  The commission questioned the crossings and their number and their plans to rehabilitate them back to their original condition.  McCulloch believed that there was only one crossing as a result of his discussions with the Department of Agriculture.  Bechtel stated that the plans showed both a roadway and crossing to be rehabilitated.   

Pederesen agreed to follow all the plans and to notify  Keith Rosenfeld  when the construction would take place.  

14-25 – CONNECTICUT WATER COMPANY – 216 MILE CREEK ROAD – CONSTRUCTION OF A PUMP STATION AND ACCESSORY.  REQUESTED FOR FINDING AS A PERMITTED BY RIGHT USE.

Nicholas Meder , Engineering Associate with the Connecticut Water Company  stated the parcel was acquired to provide additional sources of water supply to the existing Hartung  Pumping and Treatment Facility located at 1 Cross Lane.  He noted the wells were established in the Spring of 2014 and a 10 x 14 masonry structure needs to be constructed to house well control instrumentation and metering equipment.  He noted the building will not be lit or staffed.  He further stated that vehicular traffic would consist of standard service trucks and vans, including

snow removal when applicable.  He also noted toxic or hazardous materials will not be stored on this property.   

Evan Griswold made a motion to find the proposed activity a permitted by right use under Connecticut State Statutes Section 22a-40 and also a right per Section 4 e of the Town of Old Lyme Inland Wetlands and Watercourse Regulations.  Janet Bechtel seconded the motion.   The motion passed unanimously.

14-26 – CONSTANCE AYARS – 107 BOSTON POST ROAD – MODIFICATION TO PREVIOUSLY APPROVED SITE PLAN.  MODIFICATION TO INSTALL AN AERATOR WITHIN THE EXISTING POND IN ORDER TO ADD OXYGEN TO THE POND.

The commission reviewed the application submitted as well as the photographs of the site.  The commission agreed to set a site walk for Saturday, February 21, 2015 at 8:30 a.m.

14-27 – SAMUEL H. HAVENS – 24 WEST END DRIVE – PROPOSED VERTICAL EXPANSION OF SEASONAL DWELLING.   REQUEST FOR FINDING OF NO JURSIDICTION.

Attorney Harry Heller was present to discuss the application with the commission.  He explained it was a vertical expansion with no changes to the footprint of the building.  He further stated there are no wetlands on the site.

Dave McCulloch made a motion to find no jurisdiction on the proposed improvements at 24 West End Drive.   Janet Bechtel seconded the motion.   The motion passed unanimously.

14-28 – ALL PRO AUTOMOTIVE – GRAYBILL PROPERTIES – 151 BOSTON POST ROAD – RELOCATION OF EXISTING COMMERCIAL USE TO A NEW BUILDING ON THE SAME PREMISES WITHIN 100’ OF THE REGULATED AREA.

Chairman DiCamillo explained the commission would receive the application tonight but due to the outstanding issues outlined in Tom Metcalf’s letter any further action would be tabled until the February Regular meeting.   

14-29 – PETER AND CONSTANCE ROSS – 37 BROWNS LANE – PROPOSAL TO ADD BREEZEWAY MUD ROOM, GARAGE AND BREAKFAST AREA.  THE GARAGE AND BREEZEWAY IS WITHIN THE REGULATED AREA.

The commission reviewed the application and determined there was not adequate information on the plan to make a determination.  Rosenfeld will contact the applicant and research pervious files for 37 Browns Lane.

14-30 – RICHARD BATTALINO – 240-1 SHORE ROAD – PROPOSED ADDITION TO EXISTING SELF STORAGE BUILDING 100 X 25 LOCATED INSIDE OF THE FENCE WITHIN REVIEW ZONE.

The commission reviewed the site plan submitted by Mr. Battalino.  They noted they had walked the site previously.   The commission set a site walk for Saturday, February 21, 2015 at 9:00 a.m.

OLD BUSINESS

14-23 – C-TEC SOLAR, LLC – 14 SHORT HILLS ROAD – TOM & SHIRLEY CAMPO – INSTALLATION OF SOLAR PV GROUND MOUNT CONSISTING OF 24 PANELS

The representative from C-TEC Solar and Mr.  Campo were present to discuss the application with the commission.   Rosenfeld stated he had visited the site as well as some of the members of the commission.   The application is to install a pole mounted solar installation.  He noted the pole is to be mounted approximately 150 feet from the house and connected via a 3-4’ wide trench, about 2-3 feet deep.

The applicant stated that all work would be completed through Best Management Practices, including the installation of proper erosion and sedimentation controls and the construction would occur during a dry period.  

Rosenfeld stated that a walk of the property has revealed the  amount and area of actual wetland soils is probably far less than what is portrayed by the general soils mapping found on the GIS system.

Mike Moran made a motion to approve the application with the following conditions:

  • All work to be take place during a dry period.
  • Trees should be identified and marked prior to removal and inspected by the WEO.
  • The WEO to be notified prior to any construction.
Tim Rollins seconded the motion.  The motion passed unanimously.

14-21 – LONA RIVER FARMS (RIVES POTTS) – 15-2 TANTUMMAHEAG ROAD – INSTALLATION AND MAINTENANCE OF DRIVEWAY.

The commission discussed the work that has been done on the property and expressed concern about the clearing adjacent to the wetlands.   DiCamillo noted that several commission members walked the property.   Mr. Potts stated he cleaned up the area on either side of the driveway.  He noted they planted oak trees on the west side.  He stated they have installed

underground utilities and they are currently waiting for the power company to disconnect the poles so the planting can be done on the east side.  He stated it would be a total of 14 large oak trees.  He stated they had also hydro seeded the area and put hay on top to keep the erosion down.  DiCamillo stated the commission used a map from a previous proposal that was before the commission which delineated the wetlands on the site.   DiCamillo stated that normally the commission likes to see a buffer between the access and the wetlands which would be left in its natural condition.

Bechtel pointed out the wetlands markers on the site.  Bechtel stated that the commission controls everything within 100’ feet of the wetlands whether it is located on the property or on the adjacent property.  Bechtel stated the entrance into this land was an important birding habitat and therefore it would be the hope that some of that scrubby growth would be allowed to come back.   Griswold also noted that some of the growth was invasive.   He stated when the grass margin is established and if it creates a barrier to sheet flow and runoff that would be preferable to allowing the invasive growth.  Bechtel stated the commission just does not want the grass area to expand.   Potts stated the grass area is contained because there is road on one side and the swale on the other side.    Griswold also suggested that some warm grasses be planted over time so the area is not lawn and also noted that warm grasses have a much deeper root system.  

Evan Griswold made a motion to approve the Lona River Farms application at 15-2 Tantummaheag Road with the provisions that the maintenance and management of the grassy margin of the road.  Jane Bechtel seconded the motion.  The motion passed unanimously.

ZONING ENFORCEMNT OFFICER REPORT

70 MILE CREEK ROAD

Rosenfeld stated he wrote letters to the property owners on both side of the area where the dumping was seen.  He noted he immediately received a response from Bill Ruehl who cleaned the area.  

235 BOSTON POST ROAD

Rosenfeld met with the property owner Mr. Barry.   After an inspection of the site it was determined that all the best management practices where being followed.  No further action necessary.
